This CPD talk will provide a legal update on dilapidations, use of the Dilapidations Protocol, and recent case law. The speakers will be David Haines and Richard Hosmer of Charles Russell Speechlys.
The seminar will cover:
- common issues encountered in respect of contested dilapidations claims
- key issues surveyors should be aware of when considering the existence and extent of repairing obligations
- remedies in respect of dilapidations claims
- the impact of section 18(1) of the Landlord and Tenant Act 1927
- a review and guidance in respect of the Dilapidations Protocol
- a case law update.
David Haines specialises in all forms of commercial and residential property litigation and has particular expertise in commercial dilapidations claims, covenant and easement disputes, compulsory purchase order work, leasehold enfranchisement, and commercial landlord and tenant matters. He leads the firm's contentious Compulsory Purchase Order and Collective Enfranchisement teams, as well as Charles Russell Speechlys' dedicated HS2 team, set up specifically to assist clients affected or potentially affected by HS2. David has a well-established reputation and nationwide practice, acting for a variety of clients, including CitySprint, The Ernest Cook Trust, NEC and Warrant Investments PLC.
Richard Hosmer is a solicitor advising on a broad range of property disputes, including both commercial and residential landlord and tenant, as well as real property. Richard has prepared cases for the County Court, High Court and First Tier Tribunal, and also assists clients to reach settlement by alternative forms of dispute resolution where appropriate. He acts for corporate clients and private individuals.
